International research collaborations engage multiple countries, researchers, and universities. This enhances the magnitude of contextual challenges, including legal and ethical dimensions across various jurisdictions, that must be bridged in qualitative research regardless of discipline, also in the construction of informed consents. From a Scandinavian perspective, this discussion paper explores challenges pertaining to the construction of informed consents related to EU data protection legislation, to which research institutions are subject when processing data related to EU residents. Next, it discusses challenges related (...) to different traditions in terms of handling informed consent and research participants’ integrity, including the possibilities to waive anonymity in research. In international, multidisciplinary studies where researchers also operate in relatively ‘unknown territory’, it is especially important to be aware of and reflect on (inter)national possibilities and limitations related to laws, ethics, and culture/traditions in societies and within the academic fields. The variations in laws, ethical guidelines, and traditions in different countries demand that researchers are up to date with laws and ethical guidelines in the studied countries. Their practical implementation in the countries at stake in international, collaborative research endeavours are important, especially since such regulations and guidelines are far from static and change over time. The implementation of good ethical research practice requires democratic, reflexive, and responsive processes in all phases of research. Especially the preparation phase functions as a period to increase and ensure the knowledge and legal/ethical competences of the entire research team to meet the demands in the countries at stake. Background: Pediatric guidelines recommend that children and adolescents participate in a developmentally appropriate way in end-of-life decision making. Shared decision making in pediatrics is unique because of the triadic relationship of patient, parents, and physician. The involvement of the patient may vary on a continuum from no involvement to being the sole decision maker. However, the effects of child participation have not been thoroughly studied. The aims of this literature review are to identify studies on end-of-life decision making in pediatrics, (...) to explore patient participation, and to assess the effects of such participation. Methods: Five databases—PubMed, PsycInfo, Medline, CINAHL, and Sociological Abstract—were searched for empirical studies on end-of-life decision making in pediatrics. Selected articles fulfilling the criteria were assessed for type of decision, participants’ characteristics, reports on participation of the minor patient, and outcome. Results: Fifty-seven articles on end-of-life decision making in pediatrics were identified. The majority of papers (n = 43, 75%) investigated parents’ and clinicians’ perspectives, while only 14 articles (25%) included perspectives of children and adolescents. Twenty-two articles (39%) reported some details on various forms of children's participation (e.g., receive information, plan care details, consulted before or after a decision was made). Positive (e.g., respect for patient's preferences) and negative (e.g., conflict due to diverging opinions) effects of children's participation in end-of-life decision making were reported. Conclusions: This systematic review highlights the need for research to identify factors that contribute to a favorable participation of minors in decision-making processes, as well as strategies to solve possible conflicts. More research should take into account the dynamics in the triadic process of decision making and emphasize children and adolescents’ perspectives. A better understanding of how to meaningfully involve children and adolescents in end-of-life decision making could facilitate the practice of patient participation in pediatrics. (shrink)

This paper explores some key discrepancies between two sets of normative requirements applicable to the research use of personal data and human biological materials: the data protection regime which follows the application of the European Union General Data Protection Regulation, and the Declaration of Helsinki, CIOMS guidelines and other research ethics regulations. One source of this controversy is that the GDPR requires consent to process personal data to be clear, concise, specific and granular, freely given and revocable and therefore has (...) challenged the concept of ‘broad consent’, which has been widely applied in the context of biobanking. Another source of controversy is the interplay between regulations of research ethics and protection of personal data related to the secondary use of personal data and biological materials. In this case, the GDPR ‘research condition’ provides an alternative to re-consent for the use of previously collected personal data and biological materials. Although the mentioned controversies have been raised in the legal literature, they have not been explicitly addressed from the research ethics perspective. Should consent be regarded as a priority legal basis for personal data processing in health data research? Can broad consent still be a suitable legal ground for biobanking? What should be the role of research ethics provisions that differ from the GDPR standards, and what should be the role and function of research ethics committees in the changing environment of health data research? These are the ongoing controversies to be explored in the paper. (shrink)

The integration of ethics into the day-to-day work of research and innovation is an important but difficult challenge. However, with the Aachen method for identification, classification and risk analysis of innovation-based problems an approach from an engineering perspective is presented that enables the integration of ethical, legal and social implications into the day-to-day work of R&I practitioners. AMICAI appears in particular capable of providing a procedural guidance for R&I practitioners based on a method established in engineering science, breaking down the (...) object of consideration into partial aspects and prioritizing the innovation-based problems in dependence of potential risk. This enables the user to apply AMICAI continuously during all stages of the research and development process and to analyze and choose between certain sociotechnical alternatives. In this way, problems that affect ethical, legal, and social aspects can be understood, reflected and considered in the mostly technically focused R&D process. The paper gives a general guidance about AMICAI by describing principles and assumptions, providing the steps of analysis and application aids, giving an example application, explaining the necessary adjustments of AMICAI compared to the methodical basis of failure mode, effects, and criticality analysis and discussing the advantages and limits. AMICAI’s simple applications can stimulate interdisciplinary cooperation in the R&D process and be a starting point for the development of an “open RRI risk analysis platform” allowing society to evaluate innovation-based problems. Otevírá a řeší tak problém vztahu relativních objektivních (...) daností díla, jeho intersubjektivně kotvené interpretace a subjektivně vnímaného prožitku z díla. Tvorbu chápe jako způsob poznání. Cross-modal perceptual illusions occur when a stimulus to one modality impacts perceptual experience associated with another modality. Unlike synaesthesia, cross-modal illusions are intelligible as results of perceptual strategies for dealing with sensory stimulation to multiple modalities, rather than as mere quirks. I argue that understanding cross-modal illusions reveals an important flaw in a widespread conception of the senses, and of their role in perceptual experience, according to which understanding perception and perceptual experience is a matter of assembling independently viable stories (...) about vision, audition, olfaction, and the rest. Is the tick a machine or a machine operator? Is it a mere object or a subject? With these questions, the pioneering biophilosopher Jakob von Uexküll embarks on a remarkable exploration of the unique social and physical environments that individual animal species, as well as individuals within species, build and inhabit. This concept of the umwelt has become enormously important within posthumanist philosophy, influencing such figures as Heidegger, Merleau-Ponty, Deleuze and Guattari, and, most recently, Giorgio Agamben, who has called Uexküll (...) "a high point of modern antihumanism." A key document in the genealogy of posthumanist thought, _A Foray into the Worlds of Animals and Humans_ advances Uexküll's revolutionary belief that nonhuman perceptions must be accounted for in any biology worth its name; it also contains his arguments against natural selection as an adequate explanation for the present orientation of a species' morphology and behavior. _A Theory of Meaning_ extends his thinking on the _umwelt_, while also identifying an overarching and perceptible unity in nature. Those coming to Uexküll's work for the first time will find that his concept of the _umwelt_ holds out new possibilities for the terms of animality, life, and the whole framework of biopolitics itself. This paper canvasses the various dimensions along which theories of truth may disagree about the extent to which truth is minimal.

Conceptions of individual autonomy and of rational autonomy have played large parts in twentieth century moral philosophy, yet it is hard to see how either could be basic to morality. Kant's conception of autonomy is radically different. He predicated autonomy neither of individual selves nor of processes of choosing, but of principles of action. Principles of action are Kantianly autonomous only if they are law-like in form and could be universal in scope; they are heteronomous if, although law-like in form, (...) they cannot have universal scope. Puzzles about claims linking morality, reason and autonomy are greatly reduced by recognising the distinctiveness of Kantian autonomy. (shrink)

O'Hagan agrees with Dent that in Rousseau's idea of "amour-propre" we encounter a powerful, coherent model of human psychology, according to which individuals find their own identities by engaging in a network of relationships within a more or less reconstituted social order. He examines five ways in which people strive to attain that goal and five ways in which they characteristically fail. Consequentialism is often criticized for failing to accommodate impersonal constraints and personal options. A common consequentialist response is to acknowledge the anticonsequentialist intuitions but to argue either that the consequentialist can, after all, accommodate the allegedly recalcitrant intuitions or that, where accommodation is impossible, the recalcitrant intuition can be dismissed for want of an adequate philosophical rationale. Whereas these consequentialist responses have some plausibility, associational duties represent a somewhat different challenge to consequentialism, inasmuch as they embody neither impersonal constraints nor (...) personal options, but rather personal constraints. Our intuitions about associational duties resist capture within the intellectual net of consequentialism, and such duties do admit of a philosophical rationale at least as plausible as anything the consequentialist has to offer. A good deal of attention has been given in recent philosophy of religion to the question of whether we can sensibly attribute to God a form of knowledge which the 16th-century Jesuit theologian Luis de Molina termed "middle knowledge". Interest in the doctrine has been spurred by a recognition of its intimate connection to certain conceptions of providence, prophecy, and response to petitionary prayer. According to defenders of the doctrine, which I will call "Molinism", the objects of middle knowledge are (...) all the true counterfactuals of the form, 'If C were to occur, then S would freely do A', where C specifies a particular set of circumstances. (Such propositions are usually referred to as "counterfactuals of freedom" - hereafter "CFs".)' I will try to assess the current status of two distinct questions: (1) Are there true CFs? and (2) Could God know true CFs if there are any? Obviously, Molinism must answer both questions affirmatively. Most of the discussion has focused on the first question. I hope to show that this approach has been a dialectical mistake on the part of critics of Molinism, for the difficulties of giving an affirmative answer to question (2) are, I believe, far easier to state clearly and convincingly. Since 1994 the experimental art project, Paris-Réseau, has been a “(net)work in progress”. Texts, images and sounds gathered in various ways before, during and after a performance by the group Art-Réseaux at the Paris Video Library form different layers in the Paris-Réseau Archives, a hypermedia database. Paris-Réseau assembles photographs, sound samples, videos and texts to form a composite image of the city, combining digitised traces of physical places and people with information garnered from individual and collective memory.Paris-Réseau comprises at least (...) five projects. It began very simply, gradually expanding to encompass different time frames and a very large number of paths throughout the city. Then in an effort to compose all this disparate information into a coherent whole, I began zooming in on selected itineraries. Here I will just sketch out the first phases of this project which have already been described at greater length in an article published in Leonardo. (O'Rourke 1996). (shrink)

Kant’s Groundwork is the most read and surely the most exasperating of his works on practical philosophy. Both its structure and its arguments remain obscure and controversial. A quick list of unsettled questions reminds one how much is in doubt. The list might include the following: Why does Kant shift the framework of his discussion three times in a short work? Does he establish that there is a supreme principle of morality? Does he show that the Categorical Imperative is that (...) supreme principle? Does he show that human beings are free agents for whom such principles of morality are important? What is the relationship between the various apparently distinct formulations of the Categorical Imperative? To what extent are any of them action-guiding? (shrink)

Using video to facilitate data collection has become increasingly common in health research. Using video in research, however, does raise additional ethical concerns. In this paper we utilize family therapy data to provide empirical evidence of how recording equipment is treated. We show that families made a distinction between what was observed through the video by the reflecting team and what was being recorded onto videotape. We show that all parties actively negotiated what should and should not go ‘on the (...) record’, with particular attention to sensitive topics and the responsibility of the therapist. Our findings have important implications for both clinical professionals and researchers using video data. We maintain that informed consent should be an ongoing process and with this in mind we present some arguments pertaining to the current debates in this field of health-care practice. (shrink)

Previous research has reported that ethical values of business students are lower than those of their peers in other majors. The purpose of this study was to investigate whether a self-selection bias with respect to ethical values exists among students enrolled as business majors when compared with students planning to enter the engineering profession. Engineering students are exposed to a similar technical orientation in academic curricula and also supply the market for managers.A survey instrument was administered to 195 students enrolled (...) in undergraduate business and engineering programs and a graduate business program. The research instrument measured how business and engineering students perceive their own ethical beliefs and actions and how they perceived the ethical beliefs and actions of their peers. (shrink)

This paper argues that Gareth Evans' treatment of first person reference based on the myriad ways we have of receiving information about our bodies and location, cannot secure the guaranteed reference exhibited by first person reference. It faces a problem both when a subject fails to receive such information about herself, and when she receives misinformation.

This paper examines the epistemological arguments about markets and planning that emerged in a series of unpublished exchanges between Hayek and Neurath. The exchanges reveal problems for standard accounts of both the socialist calculation debates and logical empiricism. They also raise questions concerning the sources of ignorance and uncertainty in modern economies, and the role of market and non-market organisations in the distribution and coordination of limited knowledge, which remain relevant to contemporary debates in economics. Hayek had argued that Neurath's (...) work exemplified the errors of rationalism that underpinned the socialist project. In response Neurath highlighted assumptions about the limits of reason and predictability that the two theorists shared and attempted to turn those assumptions back against Hayek in a defence of the possibility of socialist planning. The paper critically compares Neurath's and Hayek's criticisms of rationalism and considers how far Neurath is successful in his attempt to employ Hayek's assumptions against Hayek himself. The most reliable manuscript of Statius' Achilleid is the Puteaneus , and its authority, against the group QKC, is frequently upheld only by the Codex Etonensis . The readings of this manuscript , which contains, apart from the Achilleid, Maximian, Ovid's Remedium Atnoris and other poems, were collated by C. Schenkl, Wiener Studien, iv , 96 ff., and were used by H. W. Garrod for the O.C.T. of Statius: Klotz in the Teubner 2nd edition merely notes the readings of Schenkl (...) and of the Oxford text. Unfortunately these are neither complete nor always accurate; and the latter should be corrected as follows: 1. In three passages the Oxford text differs from the reading of PEKQ without noting the fact: Ach. i. 145 Non superant is not, as implied, the MS. reading, but Havet's conjecture: PEKQ have nam superant. 306 PEKQ have impulsam , not impulsum. 680 PEKQ ibi, not ubi. The project of the paper is a critical examination of the "strong thesis of eliminative materialism" in the philosophy of mind--The claim that all the mental entities that constitute the framework of commonsense psychology are, In principle at least, Eliminable from our ontology. The central conclusion reached is that the traditional formulation of this thesis is demonstrably untenable as it rests on a mistaken view of the relationship between our psychological self-Knowledge and language.

Codes of professional ethics and cases designed to teach ethical decision making are written for individual professionals and ignore the systems level of analysis. They typically employ a lineal view of causality and overvalue placement of blame as a component of ethical problem solving. This article takes a systems approach to ethical problems and identifies aspects of systems that promote or impede ethical decision making. Psychological abuse of children is used as an example of a problem requiring a coordinated, systemic (...) response to ethical issues such as autonomy, privacy, and confidentiality. (shrink)

The few people familiar with the pseudo-Platonic dialogue Axiochus generally have a low opinion of it. It's easy to see why: the dialogue is a mish-mash of Platonic, Epicurean and Cynic arguments against the fear of death, seemingly tossed together with no regard whatsoever for their consistency. As Furley notes, the Axiochus appears to be horribly confused. Whereas in the Apology Socrates argues that death is either annihilation or a relocation of the soul, and is a blessing either way, "the (...) Socrates of the Axiochus wants to have it both ways": death is both annihilation and a release of the soul from the body into a better realm. This may be used to construct a valid argument for the conclusion that death is not evil, but at the expense of having a contradiction as one of its premises. But D. S. Hutchinson has recently proposed that these inconsistencies shouldn't surprise us if we view the Axiochus as "an unconventional version of a very conventional genre--the consolation letter." In this paper I expand on Hutchinson's brief suggestion and argue that the Axiochus can be rehabilitated by paying attention to its genre. Although the Axiochus does display many similarities to the consolation letter, the shift from letter to dialogue does--pace Hutchinson--significantly affect what's going on. Within the dialogue, Socrates behaves toward Axiochus in a way similar to the way the author of a consolation letter behaves towards the letter's reader: he is willing to use inconsistent arguments, borrowed from any source, in order to soothe the patient. However, in depicting this type of consolatory relationship between Socrates and Axiochus, the dialogue itself is not aiming at consoling its readers. Instead, it should be seen as displaying for the reader's consideration a certain type of consolatory argumentative practice. -/- Socrates notes that Axiochus is "very much in need of consolation" (365a), and he uses any means necessary to accomplish this task. Socrates exhibits many ways in which he is willing to sacrifice argumentative hygiene for the sake of therapeutic effectiveness. These include: -/- * Use of arguments with inconsistent premises, presented in propria persona. * Appeals to emotion * Tailoring arguments to the audience. * Presenting invalid arguments so as to induce unjustified but comforting beliefs. * Evasion. In these respects, I think that Socrates' argumentative practice is best compared to PH III 280-1, where Sextus Empiricus says that the skeptic will deliberately use logically weak arguments as long as they work. Dorothy Tarrant claims that what links the Socrates of the Axiochus to Socrates as he appears elsewhere in the Platonic corpus is his evident care for the welfare of his interlocutor's psyche. But this concern takes a quite different form in the Axiochus than it usually does. As with Sextus, psychic therapy in the Axiochus involves relief from pain. The primary difference between them is that Socrates, unlike Sextus, is not aiming at producing epochê in his patient. (shrink)

In this article, it is shown that, following the precedent set in particular by Marinus' "Life of Proclus", Damascius, in his "Life of Isidore", uses biography so as to illustrate philosophical progress through the Neoplatonic scale of virtues. Damascius applies this scale, however, to a wide range of figures belonging to pagan philosophical circles of the fifth century AD: they show different degrees and forms of progress in this scale and thus provide an edificatory panorama of patterns of philosophical perfection. (...) Each level of the scale of virtues is shown to be exemplified in Damascius' biographies. It is suggested that few, in Damascius' opinion, reached the highest levels of virtue and that philosophical decline is intimated in his descriptions of his contemporaries. (shrink)

Logical positivism is widely associated with an illiberal technocratic view of politics. This view is a caricature. Some members of the left Vienna circle were explicit in their criticism of this conception of politics. In particular, Neurath's work attempted to link the internal epistemological pluralism and tolerance of logical empiricism with political pluralism and the rejection of a technocratic politics. This paper examines the role that unified science played in Neurath's defence of political and social pluralism. Neurath's project of unified (...) science addressed problems that lie at the centre of recent debates around liberalism concerning the possibility of social co-operation in conditions of pluralism. His response is distinctive in calling upon an empiricist tradition that differs from Kantian proceduralist approaches that have predominated in recent liberalism. While Neurath's position has problems, it deserves reconsideration, especially in so far as it questions the Kantian assumption that a thin language of abstract rights provides the best basis for the cosmopolital lingua franca required by conditions of social pluralism. An investigation of the role that unified science plays in Neurath's politics also gives reasons for revising common misconceptions about the nature of the unity of science programme itself. Zur Zeit des Hl. Thomas von Aquin war es nicht leicht andere Religionen zu verstehen. Besonders auch deswegen nicht, weil die Verbreitung der Religion mit Macht und Krieg verbunden war. Aber gerade Thomas hat die sogenannte „Heidnische Lehre“ des Aristoteles in das Christentum eingeführt. In den Augen vieler orthodoxen Christen war dies ein unverzeihlicher Fehler. Mit dieser Lehre ist auch das Naturrecht (moralisch natürliche Gesetz) in die katholische Theologie eingeführt worden. Aber die Aristotelische Wiedereinführung (wenn nicht Revolution) in die christliche (...) Philosophie ist bis heute nicht ohne Hindernisse geschehen. Chesterton meint, dass Thomas korrigiert Platon mit Aristoteles, der die Dinge so genommen hat, wie er sie vorgefunden hat. Thomas nimmt die Dinge so, wie sie Gott geschaff en hat. Trotz allem ist es sehr wertvoll zu denken, dass die Wahrheit und der Glaube nicht im Widerspruch stehen können, und alles was die Wissenschaft ans Licht der Welt bringt, kann nicht im Widerspruch gegenüber dem Glauben sein. In den Werken des Hl. Thomas ist immer die Welt der positiven Schöpfung gegenwärtig. In dieser Arbeit möchten wir die Bedingungen der Zeit des Dialogs mit dem Islam und dem Judentum als Hintergrund für die Zusammenfassung der Summa contra Gentiles analysieren nach den Gedanken von M.-D. Chenu, O. H. Pesch, J. Weisheipl, K. G. Chesterton und anderen, die uns ein Bild über die nicht einfache aber trotzdem erreichbare Begegnung mit anderen Religionen zeigen und auch die Gefahr aufzeigen, die sich in einer nicht konsequenten Philosophie birgt.
